房屋租赁合同

甲、乙双方就下列房屋的租赁达成如下协议:

第一条 房屋基本情况。

甲方房屋(以下简称该房屋)坐落于 第层。

第二条 房屋用途。

该房屋用途为租赁住房。

除双方另有约定外,乙方不得任意改变房屋用途。

第三条 租赁期限。

租赁期限自___年___月___日至___年___月___日止。

第四条 租金。

该房屋月租金为(人民币大写)千 百拾元整。

租赁期间,如遇到国家有关政策调整,则按新政策规定调整租金标准;除此之外,出租方不得以任何理由任意调整租金。

第五条 付款方式。

乙方按支付租金给甲方。

第六条 交付房屋期限。

甲方应于本合同生效之日起 日内,将该房屋交付给乙方。

第七条 甲方对房屋产权的承诺。

甲方保证拥有房屋产权,提供相应证明。在交易时该房屋没有产权纠纷;除补充协议另有约定外,有关按揭、抵押债务、税项及租金等,甲方均在交付房屋前办妥。交易后如有上述未清事项,由甲方承担全部责任,由此给乙方造成经济损失的,由甲方负责赔偿。

第八条 维修养护责任。

正常的房屋大修理费用由甲方承担;日常的房屋维修费用由乙承担。

因乙方管理使用不善造成房屋及其相连设备的损失和维修费用,由乙方承担并责任赔偿损失。

租赁期间,防火安全,门前三包,综合治理及安全、保卫等工作,乙方应执行当地有关部门规定并承担全部责任和服从甲方监督检查。

第九条 关于房屋租赁期间的有关费用。

在房屋租赁期间,以下费用由乙方支付:水、电费;

第十条 租赁期满。

1、租赁期满后,如乙方要求继续租赁,甲方则优先同意继续租赁;

2、租赁期满后,如甲方未明确表示不续租的,则视为同意乙方继续承租;

第十一条 因不可抗力原因导致该房屋毁损和造成损失的,双方互不承担责任。第十二条 本合同未尽事项,由甲、乙双方另行议定,并签订补充协议。补充协议与本合同不一致的,以补充协议为准。

第十三条 本合同之附件均为本合同不可分割之一部分。本合同及其附件内,空格部分填写的文字与印刷文字具有同等效力。

本合同及其附件和补充协议中未规定的事项,均遵照中华人民共和国有关法律、法规和政策执行。

LEASE AGREEMENT

THIS AGREEMENT OF LEASE is made on this 16th day of December 2003 by and BETWEEN:-

Mrs. Ghazala Waheed w/o Abdul Waheed, Adult, R/o House No.***-*, DHA, Lahore Cantt, (hereinafter to as the LESSOR of the ONE PART).

And

Mr.* ***,R/o China, refereed to as the LESSEE of the OTHER PART.(Expression “LESSOR” and “LESSEE” wherever the context so permit shall always mean and include their respective heirs, successors legal representative and assignees).

WHEREAS the LESSOR is the lawful owner and in lawful possession of House No,***-*,DHA, Lahore Cantt, consisting of 4 Bedrooms with bath, D/D,TV; Lounge, Kitchen, Store, Servant, Quarter together with fixtures and fitting (hereinafter collectively called the DEMISED PREMISES).

AND WHEREAS the LESSOR has agreed the lease and the LESSEE has agreed to take on lease the DEMISED PREMISES on the terms and condition as given below:-

1. This agreement in only valid if LESSEE is renewed and extended for the lease period.

2. The LESSOR lets LESSEE takes the DEMISSED PREMISES for a period of 12 months

Commencing from 15th January 2004. The Lease is renewable for a further period as may be mutually agreed in writing on expiry of the lease period

3. The rent of the DEMISED PREMISES shall be USD3,300/-(US dollars Three Thousand and Three hundred Only) per month

4. The LESSOR hereby acknowledges receipt of the sum of USD.19,800/-(US dollars Nineteen Thousand and eight Hundred Only) per month.

5. It is hereby agreed between the parties that the LESSEE shall pay the aforesaid monthly rent USD. 3,300/-(US dollars Three Thousand and Three hundred Only) as the monthly rental advance by 20th of each calendar month for which if is due after completion of advance rent period ending on 15th July 2004.

6. That the LESSOR hereby acknowledges receipt of the sum of Rs.60,000/-(Rupees Sixty Thousand Only) from the LESSEE as FIXED EDPOSIT SECURITY which shall be refunded to the LESSEE on giving back the vacant possession of the DEMISED PREMISES after deduction of damages/shortages outstanding bills for Electricity, Water, Gas and Telephone charges etc, against the DEMISED PREMISES.

THE LESSEE HERBY CONVENANTS WITH LESSOR AS FOLLOWING:

1. To pay to the LESSOR the rent hereby reserved in the manner before mentioned.

2. That the LESSEE shall not at any time during the terms, without the consent in writing of the LESSOR, pull down, damages or make any structure alterations to the DEMISED PREMESES provided always, the LESSEE shall have go write install any fixtures and fittings excluding air-conditioners in the DEMISED PREMESES, to detach and repossess the same s

ubject to the restoration of the DEMISED PREMESES to their original state at his cost (reasonable wear and tear excepted) on the expiry of this lease or any renewal hereof.

3. To use the DEMISES PREMISES for residential purpose and would not be used for a commercial purpose the DEMISES PREMISE would not be used occupied by Mr. **** And family.

4. Not to sublet the whole or any part of the premises.

5. To pay regularly the bills for Electricity, Gas, Water and Telephone charges in respect of the DEMISED PREMISES. A copy of all the paid utility bill be forwarded to the LESSOR every three month regularly. In case of disconnection of any facility due to non-payment, LESSEE will be responsible to get them restored and pay the same. All dues must be cleared before the expiry of the LEASE.

6. The LESSEE shall keep and maintain the said premises in good and tenantable conditions during the tenure of the lease.

THE LESSOR HEREBY CONVENANTS WITH THE LESSEE AS FOLLOWING:-

1. To pay all existing and future rate, taxes assessments and other charges of a public nature whether impose by the Municipality, Government or any other authority in respect of DEMISED PREMISES.

2. Not to erect or set up a building or structure on the DEMISES PREMISES nor to add to any existing building or structure during the period of lease or any renewal without the written consent of the LESSEE.

IT IS HEREBY DECLEAR AND MUTURALLY AGREED BETWEEN THE LESSOR AND LESSEE ANS FOLLWING:=

1. The LESSEE and the LESSOR shall have the right and option to terminate this Lease at any time only after the expiry of the lease period i.e., 24 months, provided they give ONE (1) month notice in advance to either of the parties.

四、租金

4. Rental

In this situation, Party A has the right to take back the premises and take actions against party B‘s breach.

五、押金

5. Deposit

1. 为确保房屋及其附属设施之安全与完好,及租赁期内相关费用之如期结算,乙方同意于______ 年___ 月 ___ 日前支付给甲方押金________ 元整,甲方在收到押金后予以书面签收。

1)Guarantying the safety and good conditions of the premises and attached facilities and account of relevant fees are settled on schedule during the lease term, party B shall pay to party A as a deposit before ____ (month) (day) ___ (year). Party A shall issue a written receipt after receiving the deposit.

2. 除合同另有约定外,甲方应于租赁关系消除且乙方迁空、点清并付清所有应付费用后的当天将押金全额无息退还乙方。

2) Unless otherwise provided for by this contract, Party A will return full amount of the deposit without interest on the day when this contract expires and party B clears the premises and has paid all due rental and other expenses.

3. 因乙方违反本合同的规定而产生的违约金、损坏赔偿金和其它相关费用,甲方可在押金中抵扣,不足部分乙方必须在接到甲方付款通知后十日内补足。

3)In case party B breaches this contract, party A has right to deduct the default fine, compensation for damage or any other expenses from the deposit. In case the deposit is not sufficient to cover such items, Party

B should pay the insufficiency within ten days after receiving the written notice of payment from Party A.

4. 因甲方原因导致乙方无法在租赁期内正常租用该物业,甲方应立即全额无息退还押金予乙方,且乙方有权追究甲方的违约责任。

4)If Party B can’t normally use the apartment because of Party A, Party

A should return the deposit to Party B at once. And Party B has the right to ask for the compensation from Party A.

六、甲方义务

6. Obligations of Party A

1. 甲方须按时将房屋及附属设施(详见附件)交付乙方使用。

1)Party A will provide the premises and attached facilities (see the appendix of furniture list for detail) on schedule to Party B for using.

2. 房屋设施如因质量原因、自然损耗、不可抗力或意外事件而受到损坏,甲方有修缮并承担相关费用的责任。如甲方未在两周内修复该损坏物,以致乙方无法正常使用房屋设施,乙方有权终止该合约,并要求退还押金。

2)In case the premise and attached facilities are damaged by quality problems, natural damages or accidents, Party A will be responsible to repair and pay the relevant expenses. If Party A can‘t repair the damaged facilities in two weeks so that Party B can’t use the facilities normally, Party B has the right to terminate the contract and Party A must return the deposit.

3. 甲方应确保出租的房屋享有出租的权利,如租赁期内该房屋发生所有权全部或部分转移、设定他项物权或其他影响乙方权益的事件,甲方应保证所有权人、他项权利人或其他影响乙方权益的第三者能继续遵守本合同所有条款,反之如乙方权益因此遭受损害,甲方应负赔偿责任。

3)Party A will guarantee the lease right of the premise. In case of occurrence of ownership transfer in whole or in part and other accidents affecting the right of lease by party B. party A shall guarantee that the new owner, and other associated, third parties shall be bound by the terms of this contract. Otherwise, Party A will be responsible to compensate party B‘s losses.

4. 甲方应为本合同办理登记备案手续,如因未办理相关登记手续致该合同无效或损害乙方租赁权利,应由甲方负责赔偿,且甲方应承担该合同相关的所有税费。

4)Party A must register this contract with the relevant government authority If not doing so resulting that this contract is invalid or Party B‘s right of leasing may be damaged, Party A should take the all

responsibilities. Party A should also bear the all the relevant taxes

七、乙方义务

7. Obligations of Party B

1. 乙方应按合同的规定按时支付租金及押金。

1)Party B will pay the rental and the deposit on time.

2. 乙方经甲方同意,可在房屋内添置设备。租赁期满后,乙方将添置的设备搬走,并保证不影响房屋的完好及正常使用。

2)Party B may add new facilities with Party A‘s approval. When this contract expires, Party B may take away the added facilities without changing the good conditions of the premises for normal use.

3. 未经甲方同意,乙方不得将承租的房屋转租或分租,并爱护使用该房屋如因乙方过失或过错致使房屋及设施受损,乙方应承担赔偿责任。

3)Party B will not transfer the lease of the premises or sublet it without Party A‘s approval and should take good care of the premises. Otherwise, Party B will be responsible to compensate any damages of the premises and attached facilities caused by its fault and negligence.

4. 乙方应按本合同规定合法使用该房屋,不得擅自改变使用性质。乙方不得在该房屋内存放危险物品。否则,如该房屋及附属设施因此受损,乙方应承担全部责任。

4)Party B will use the premises lawfully according to this contract without changing the nature of the premises and storing hazardous

materials in it. Otherwise, Party B will be responsible for the damages caused by it.

5. 乙方应承担租赁期内的水、电、煤气、电话费、收视费、一切因实际使用而产生的费用,并按单如期缴纳。

5)Party B will bear the cost of utilities such as telephone communications, water, electricity and gas on time during the lease term.

八、合同终止及解除的规定

8. Termination and dissolution of the contract

1. 乙方在租赁期满后如需续租,应提前一个月通知甲方,由双方另行协商续租事宜。在同等条件下乙方享有优先续租权。

1)Within one month before the contract expires, Party B will notify Party

A if it intends to extend the lease. In this situation, two parties will discuss matters over the extension. Under the same terms Party B has the priority to lease the premises.

2. 租赁期满后,乙方应在 日内将房屋交还甲方;任何滞留物,如未取得甲方谅解,均视为放弃,任凭甲方处置,乙方决无异议。

2)When the lease term expires, Party B will return the premises and attached facilities to Party A within days. Any belongings left in it without Party A's previous understanding will be deemed to be abandoned by Party B. In this situation, Party A has the right to dispose of it and Party B will raise no objection.

3. 本合同一经双方签字后立即生效;未经双方同意,不得任意终止,如有未尽事宜,甲、乙双方可另行协商。

3)This contract will be effective after being signed by both parties. Any party has no right to terminate this contract without another party’s agreement. Anything not covered in this contract will be discussed separately by both parties.

九、违约及处理

9. Breach of the contract

1. 甲、乙双方任何一方在未征得对方谅解的情况下,不履行本合同规定条款,导致本合同中途终止,则视为该方违约,双方同意违约金为 ___ 元整,若违约金不足弥补无过错方之损失,则违约方还需就不足部分支付赔偿金。

1)During the lease term, any party who fails to fulfill any article of this contract without the other party's understanding will be deemed to breach the contract. Both parties agree that the default fine will be___ .

In case the default fine is not sufficient to cover the loss suffered by the faultless party, the party in breach should pay additional compensation to the other party.

2. 若双方在执行本合同或与本合同有关的事情时发生争议,应首先友好协商;协商不成,可向有管辖权的人民法院提起诉讼。

2)Both parties will solve the disputes arising from execution of the contract or in connection with the contract through friendly consultation. In case the agreement cannot be reached, any party may summit the dispute to the court that has the jurisdiction over the matter.

3. 本合同一经双方签字后立即生效;未经双方同意,不得任意终止,如有未尽事宜,甲、乙双方可另行协商。

十、其他

On expiry of this lease, Party A has the right to take back the leased property(including all

the furniture, fittings and equipment listed in Appendix II)in full, and Party B must deliver

the leased property on the date of expiry. If Party B wishes to extend the lease, Party B

shall have the priority to renew the lease with two months advance written notice to Party

A. The revised rental shall be negotiated between the two parties.

2.4 租赁期间,若甲方或甲方的继承人出售该房屋时,乙方自愿无条件放弃优先购买房屋

的权利。如甲方或甲方的继承人转让本租赁物业产权给第三方(“受让人”),甲方必

须在产权转让生效前三个月通知乙方,并使该受让人与乙方达成协议,受让人承诺以

房东身份继续根据本租赁合同的条件和条款履行本租赁合同,特别是根据本租赁合同

规定,履行将保证金交还乙方的责任。如乙方因受让人拒绝与乙方签订上述协议或违

反本合同而蒙受任何费用和损失,甲方应给予全部补偿。

During the lease term, if party A or his/her heir sells this house, party B is willing to waive

the preferential right to purchase this house without any condition. In the event that during

the lease term, Party A transfers the ownership title of the Premises to a third Party (the

"Transferee"), Party A must notify the Party B three months in advance of the transfer

before the ownership transfer takes effect and cause the transferee to enter into an

agreement with the Party B that the transferee shall continue to perform this Tenancy

Agreement as the Landlord under same terms and conditions hereof, and in particular, be

obliged to repay the Security Deposit to the Party B in accordance with the provision herein . Party A shall indemnify Party B against any damages and costs resulting from the refusal by the Transferee to enter into the aforesaid agreement with Party B or any actions by the Transferee in violation of this Tenancy Agreement.

3.1 租金每月为含税费人民币, 包括。

相应延付租金。

Party B shall pay each six months' rent in advance, on or before the day of each six calendar months, by remitting the amount of such rent to a bank account designated by Party A (as referred to in Appendix I). The date of remittances shall be the date of payment. Party A shall provide to Party B the official after-tax invoice within ten (10) days before Party B makes each payment. In case Party A fails to do so, Party B shall have the right to withhold rental payment.

3.3 租金款以人民币支付, 在本租约有效期内,租金不予调整。

The rent shall be paid in RMB. The rent cannot be adjusted during the term of this Tenancy Agreement.

3.4 本租约签订后的首六个月租金, 额付给甲方。

Part B shall pay the rent for first six months in full the signature of this agreement and meanwhile get the official tax invoice.

第4条 押金:

Deposit:

4.1 乙方应向甲方缴付相当于元。乙方如不再

续租,乙方应在租赁期结束的当日将全部水,电,煤气费和应由乙方支付的杂费及电

话费等付清。如因帐单延期等原因,乙方承担的全部水,电,煤气费等杂费及电话费无法在租赁期结束的当日内付清,乙方应向甲方支付水、电、煤、电话等公共事业费押金,但保留的押金部分不因超过上一帐期水,电,煤气费、电话费总额的二倍,待

相关费用数额确定后,扣除相关费用,退还剩余部分。

total. On completion of the tenancy period, if Party B will not continue to rent the leased

property, Party B must clear the entire outstanding utilities fee such as water, electricity,

gas, fee and telephone bill on the day of checkout. If such outstanding utilities fee could

not be settled because of limitation of the account due date, Party B shall deposit an

amount of cash to Party A, which amount shall not exceed two times of the paid utility

bills of the previous month.After the outstanding utilities fee could be confirmed, the

deposit will be refunded to Party B after deducted the related fees.

4.2 在租赁期内,因乙方原因而终止租约(不可抗力除外),押金不予退还。 如

在租约签订后,房租及押金支付前,因乙方原因而终止租约,乙方支付甲方相当于壹

个月租金的赔偿金,并支付房东税费损失。若甲方或乙方因有特殊原因,经双方协商

一致,甲方可以提前收回房屋或乙方可以提前退租,无需向对方支付相当于一个月房

租的补偿。

If Party B terminates the Tenancy Agreement during the lease term for reasons other than Force Majeur, the paid deposit will not be refunded. If Party B terminates the Tenancy Agreement after the signature of this agreement, and Party B has not paid the rent or the deposit by that time, Party B pays Party A one (1) months rent as compensation and also the money of tax losses. If Party A or Party B has special cause, after friendly negotiation, Party A could withdraw the property or Party B could move out without paying the one month rent as compensation if both parties agree.

4.3 甲方因乙方违反本合同的规定而遭受的损失,可在押金中扣抵合理数目,在甲方做出

该种扣抵前,需书面通知乙方将被扣抵的金额和理由,乙方有权拒绝不合理或不公正 的抵扣,经乙方确认的可以抵扣,不足部分乙方必须在接到甲方付款通知后十天内补

足。

Party A may deduct a reasonable amount from the security deposit towards payment of any actual damages Party A may have incurred or suffered as a result of Party B's breach of this Agreement. Prior to making such deductions, Party A shall inform Party B with written notice of the amount which it intends to deduct and the reason for making such deductions. Party B shall be entitled to object to such deductions if Party B believes that such deductions are ueasonable or unjustified. If the security deposit is not sufficient to cover such amounts, Party B must pay the deficiency within ten ( 10 )days of the receipt of a demand from Party A after the confirmation of Party B.

4.4 押金以人民币支付,甲方收到押金后,向乙方提供带有甲方签名的收据。

The deposit shall be paid in RMB. Party A shall provide to Party B a receipt bearing Party A’s signature upon receiving above deposit.

5.1 乙方在租赁期内所用的水、电、煤气(天然气)等相关,物业管理公司或公共事业部门

将每月按房屋实际耗用量结算,乙方按单缴付。

During the period of tenancy, Party B shall pay monthly all charges for usage of water, electricity, gas and etc based on the actual consumption amount billed by the management office or related government utility bureaus.

5.2 乙方所用电话, 按电信局标准收费,每月根据实际用量结算,乙方按单缴付。

All telephone charges shall be paid by Party B and based on the actual usage according to the Telecommunication Bureau standard tariffs on receipt of the bills.

第6条 甲方的责任:

6.1 本租约签订后,甲方不得无故收回房屋,如甲方中途要求收回房屋,乙方有权拒绝。

Party A is not permitted to take back the leased property during the term of the contract without any reason. If Party A wishes to do so, Party B has the absolute right to refuse.

6.1.1 如乙方同意解除租约且乙方已按4.1条约定交纳租金及押金并已入住, 则甲方必须退

还乙方剩余尚未住部分的租金并双倍返还乙方已付押金,本租约于甲方发出解约通知二个月后终止。若甲方或乙方因有特殊原因,经双方协商一致,甲方可以提前收回房

屋或乙方可以提前退租,无需向对方支付相当于一个月房租的补偿。

If Party B agrees to terminate the Agreement whereas Party B has paid the rent and deposit according to Clause 4.1 and has moved in to the properties, Party A shall refund Party B the rental according to the actual living days and pay twice the amount of the deposit to Party B, and the Agreement will be terminated two (2) months later after Party A issues the notice. If Party A or Party B has special cause, after friendly negotiation, Party A could withdraw the property or Party B could move out without paying the one month rent as compensation if both parties agree.

6.1.2 如乙方同意解除租约且乙方已按约定交纳租金及押金但尚未入住, 则甲方必须返还

乙方已付的租金及双倍返还押金, 且本租约自甲方发出解约通知之日起终止。

If Party B agrees to terminate the Agreement whereas Party B has paid the rent and deposit according to Clause but has not moved in the property, the Agreement will be terminated when Party A informs Party B with written notice of termination, and Party A shall pay Party B the paid rental, as well as twice the amount of the deposit which Party B has already paid.

6.1.3 本租约签订后, 乙方未交纳租金或押金前, 若甲方欲解除本租约, 则应向乙方支付相

当于壹个月租金的赔偿金,本租约在甲方支付赔偿金的当日解除。

If Party A wants to rescind the Agreement after the signature of this Agreement, and Party

B has not paid the rent or the deposit by that time, the Agreement can be terminated only after Party A has paid Party B one (1) months rent as compensation. The termination of the Tenancy Agreement effects on the day when party A pays the compensation to Party B.
