根据中华人民共和国法律、法规，双方在平等、自愿、协商一致的基础上签订本聘用合同。
甲、乙双方的权利和义务由本合同中约定，双方确认已经充分理解，并且将完全履行合同的任何条款。除非乙方在订立合同当时明确表示保留或者取消，否则乙方放弃任何针对本合同条款的抗辩权。
一、合同期限
第一条

1.3甲方可根据乙方的实际工作能力和表现决定是否缩短试用期。试用期内任何一方可依法书面通知对方解除本合同。
1.4试用期内乙方有不符合甲方录用标准的行为，由于乙方故意隐瞒原因使甲方在试用期满后才得以知晓的，甲方有权按照试用期内解除本合同的规定解除与乙方的聘用合同，甲方不需向乙方支付经济补偿金。
二、工作岗位及工作岗位的调整
第二条 工作岗位
2.1甲方根据工作需要及乙方的岗位意向，聘用乙方在______ 部门，担任______专业岗位工作。
2.2乙方应当完成的工作量以及应当达到的质量标准为：（注：该工作岗位职责因篇幅要求可以附件的形式列明。）
2.3乙方应始终胜任受聘岗位，并且高效履行相应的各项职责和义务。
2.4乙方应按时、按质、按量的完成甲方交付的工作任务，并且交付聘用成果或以约定的方式履行合同义务。
2.5乙方在本合同履行期间在没有得到甲方事先的书面同意前，乙方不能直接或间接地受聘于其他单位或个人。
第三条 工作岗位的调整
3.1甲方根据工作需要及乙方的工作能力和表现，可以调整乙方的工作岗位，乙方应服从。
3.2当乙方工作岗位调整时，甲方相应调整乙方的岗位工资及福利待遇。
3.3当乙方对于甲方调整工作岗位有异议时，可以按照甲方规章制度规定的程序向甲方提出异议或者辞职，但乙方异议的提出不影响甲方决定的执行，乙方应当办理岗位调动交接手续，并到新的岗位提供服务。
三、工时制度和工作条件
第四条 工时制度
4.1 甲方实行与本单位工作性质相适应的，且符合国家和所在地相关聘用法规的工作和休息制度。
4.2 根据甲方工作需要和乙方的工作岗位，甲方安排乙方执行标准工时制度。乙方每日工作时间8小时，每周工作40小时。
4.3当乙方工作岗位发生变更时，乙方须服从工作的需要调整工作时间。
第五条 延长工作时间
5.1甲方根据工作需要，可以依法安排乙方加班。
5.2乙方经过甲方批准方可加班。乙方申请加班应当按照甲方规章制度规定的程序执行。
5.3甲方保证乙方每周最少休息一天。
5.4甲方安排乙方加班或者批准乙方加班的，应当按照国家及河北省规定以及甲方规章制度安排乙方补休或者支付加班工资，加班工资由所在部门于下月单独支付。每个月加班不得超过36小时。
5.5 按时按量完成甲方交付的工作是乙方的责任，如乙方未能按时按量完成工作而自行或必须加班的，甲方不支付相应的加班工资或安排乙方补假。
第六条 甲方为乙方提供必要的工作条件和工作工具，制定操作规程、工作范围和工作安全卫生制度。
第七条 乙方应当遵守中国的法律、法规、规章及甲方制订的各项制度。
第八条 出差
本合同履行期间，乙方应当接受甲方因公出差的任务。乙方出差期间的待遇按照甲方有关规定执行。

I. 乙方自愿作为甲方外教在甲方从事教学服务工作。双方在友好合作的基础
上签订本合同，并保证遵守合同中所规定的各项条款。
Party Bwishes to engage the service of Party A as a foreign teacher. The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations stipulated in it.

III. 乙方的职责
The duties of Party B
1. 乙方在合同有效期内的工作时间为每周小时。
Party Bshall work hours per week during the contract constraint
period.
2. 乙方的工作内容包括但不仅限于面授课、备课（教学计划、课程计
划和批改作业等）、课程研发、与其它教师和家长的交流，以及参加
学校的活动。
The contents of Party B’s workinclude but not limited to lectures,
preparing for lessons (teaching plans, lesson plans, homework
making, etc.),curriculum design& development,communication
with parents and the other teachers, and participating in school
events.
IV. 乙方的报酬
1. 甲方将对乙方执行为期2个月的试用。在试用期间，甲方将向乙方
支付的试用期工资为：元。乙方在甲方工作期间的基本月工资为：
元，以人民币形式支付。如乙方每月授课时间多于110小时，超出
的授课时间，可获得每课时120元的额外津贴。
Foreign Teachers will have 2 months trial period, the monthly
salary for a probationary period is RMB. Party B's monthly salary
will be RMB by cash. If the teaching hours are more than 110 hours
per work-month, Party B will get 120 RMB for teaching
compensation per extra teaching hour.
2. 乙方可获得工作期间的意外伤害保险。
Party A shall purchase accident insurance for Party B.
3. 乙方在中国享有以下假期和假日：元旦，春节，“五一”劳动节，国
庆节以及法律、法规中所规定的其他节日。
Party B is entitled to the following paid holidays and festivals in
China, including New Year's Day, Spring Festival, May Day,
National Day and other holidays stipulated by Chinese laws and
regulations.

6. 不超过20天。单次事假原则上不能超过3天，超过3天后每天扣除2天的工资。 Private affairs leave of the party B shall be approved by party A in advance. The party A will deduct the salary for Party B by day. Within the contract term, the private affairs leaves should not exceed 20 days in total. The continuous private affairs leave shall be no more than 3 days, and double days' salary will be deducted for each day thereafter. 不经甲方批准擅自离职，每旷工一天扣除3天的工资。在特殊情况下，甲方有权对违反规则的乙方终止合同并调查乙方的可靠性。 In case of absence from work without Party A’s permission, 3 days' salary will be deducted for each day absent. For serious circumstances, Party A has the right to terminate the contract and investigate the liability of Party B for violation of the contract. 工资的支付日期为次月10日。

V. 甲方义务
Party A's Obligations
1. 甲方有义务向乙方介绍甲方所在当地的相关法律、法规以及甲方工
作机制、规程、规定以及与外国专家管理相关的规章制度。
Party A shall introduce to Party B the laws, decrees and relevant regulations enacted by the Chinese government, the Party A' work system and regulations concerning administration of foreign experts.
2. 甲方对乙方的工作负责指导、监督以及评价。
Party A shall conduct direction, supervision and evaluation of Party B's work.
3. 甲方应向乙方提供必要的工作设施。
Party A shall provide Party B with necessary working facilities.
4. 甲方应向乙方每月按期发放工资。
Party A shall pay Party B's salary regularly by the month.
5. 甲方将对乙方的工作进行指导和评估。
Party A will provide guidance and evaluation of Party B’s work.
VI. 乙方义务
Party B's obligations
1. 乙方必须遵守中国的法律、法规和将关规定，不干涉中国内政。
Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China's internal affairs.

7. 受甲方在工作方面的安排、指导、监督和评价。未经甲方批准，乙方不得从事任何兼职工作。 Party B shall observe Party A's work system and regulations concerning administration of foreign experts and shall accept Party A's arrangement, direction, supervision and evaluation in regard to his/her work. Without Party A's consent, Party B shall not render service elsewhere or hold concurrently any post uelated to the work agreed on with Party A. 乙方必须按照计划保质保量完成甲方委派的工作。 Party B shall complete the tasks agreed on schedule and guarantee the quality of work. 乙方必须遵守中国的宗教政策，不允许从事与外籍专家身份不符的宗教活动。乙方必须尊重中国人民的道德规范和风俗习惯。 Party B shall respect China's religious policy, and shall not conduct religious activities incompatible with the status of an expert. Party B shall respect the Chinese people's moral standards and customs. 乙方如有严重疾病或传染性疾病、或者女性有怀孕、待产、哺乳等情况，必须在签订合同之前，向甲方如实声明，否则造成后果由乙方承担全部责任。 If Party B has any contagious or serious diseases, or if Party B is female in pregnancy, child birth or baby nursing period, Party B has the duty to inform Party A before the contract is signed so that Party A can provide special care to Party B. Otherwise, Party A will not bear any related responsibilities. 乙方同意并授予甲方处于市场和宣传活动使用乙方真实的个人信息和肖像. Party A is permitted and authorized by Party B to use his/her true personal information for marketing and advertising activities, including the using of Party B’s personal photographs. 乙方研究、开发及教学成果的版权属于甲方，包括《中华人民共和
国著作权法》规定的全部人身权利和全部财产权利。未有甲方书面许可，乙方将不得出于任何目的使用之。乙方确保其研究、开发及教学成果不侵犯任何第三方的知识产权。
The Copyrights of results of researching, developing and teaching from Part B belong to Part A, including personal rights and complete property rights specified in The Copyright Law of People’s Republic of China. It is forbidden for Part B to use the copyrights for any purposes without any authorized written documents from Part A. Part B should guarantee that his/her researching, developing and teaching results will not violate third-party intellectual property rights.
VII. 合同的终止
Termination of Contract
1. 在以下情形下，甲方将书面通知解除与乙方的合同：
Party A will terminate the contract with written notice to the Foreign Teacher under such circumstances:
(1) 如果乙方违反了中华人民共和国相关法律法规、合同体系工作
要求、中国政府关于外籍人员的相关管理办法及合同的相关事
宜，甲方将解除与乙方的合同。乙方将不能得到补偿。
The contract will be terminated immediately if Party B in
violation of the laws and regulations of China, party work
system of employer, and the regulation of Chinese
government about Foreign Teachers or other contract terms.
In this situation, no compensation;
(2) 如果乙方不能满足合同中要求的工作表现，甲方将解除与乙方
的合同。甲方将考虑给予乙方15天的工作改变期来改善乙方的
工作，如果在15天工作改善期之后乙方之工作仍然没有改善，
甲方将解除与乙方的合同。乙方将不能得到额外的补偿。
If Party B fails to satisfactory perform his/her duties and
responsibilities, the contract will be terminated immediately,
Or, at the sole discretion of Party A, Party B will be given 15
days to improve his/her job performance. If, after 15 days, the
Foreign Teacher has not improved his/her job performance to
the satisfaction of Party A, the contract will then be terminated
and Party B will not receive any additional pay;
(3) 乙方在得到执业医师证明的前提下，如不能完成或者继续完成
其合同工作超过30天，甲方将解除与乙方的合同。在这种情况
下，乙方将不能得到额外的补偿。
If, in the judgment of a qualified medical doctor, Party B is
unable to resume his/her duties and responsibilities after the
expiration of 30 days of sick leave. In this instance, no further
payments will be made to Party B.
2. 如果乙方提出解除与甲方的合同，乙方必须于合同解除日前30天向
甲方书面提出解除合同。在这种情况下，乙方将能够得到工作时间范畴内的全工资。否则，乙方将不能够获得工资及奖金和提成。
If Party B chooses to terminate the contract, he/she must provide thirty days’ written notice to Party A. If this is done, Party B will receive full salary for the period worked. Otherwise, salary and vacation subsidiary will not be paid.
VIII. 违约金

一、合同期限

Salary was calculated from June 30, 2014 to September 1, 2013.From July 1, 2014 to July 15, 2014, the salary is not calculated. This time that Party B deal with some affairs in China. If Party B intends to stay in China after July15，2014， the Party B will bear all the costs.
1.2 本合同规定乙方的试用期为 1 个月，自 2014 年 9 月1 日至 2014 年 9 月 30 日止。
The probationary period for Party B is one month, starting from day of 1.3 甲方可根据乙方的实际工作能力和表现决定是否缩短试用期。试用期内任何一方可依法书面通知对方解除本合同。
Party A will decide whether or not to shorten the probationary period based upon Party B’s proved capacity. During the probationary period, either Party can terminate the Contract upon informing the other Party in a written form according to law.
1.4 试用期内乙方有不符合甲方录用标准的行为
隐瞒原因使甲方在试用期满后才得以知晓的， 甲方有权按照试用期内解除本合同的规定解除与乙方的聘用合同， 甲方不需向乙方支付经济补偿金。
Should Party B conduct acts during the probationary period that do not meet Party A’s recruitment requirements and Party A does not know them until after the probationary period because of Party B’s intentional efforts to conceal them, then Party A has the right to terminate the Contract in accordance with provisions concerning termination of the Contract during the probationary period without paying any compensation to Party B.
1.5 如果乙方在试用期内解除本合同，甲方有权不履行本合同第 七条规定的为乙方购买往返机票之义务。
If Party B terminates the contract during the probationary period, Party A has the right not to perform the obligation of purchasing return air tickets for Party B under the provisions of article seven in contract.
